Although there are not a lot of publicized medical malpractice cases pending in New York City, it is topic that has taken the spotlight following the death of the "King of Pop," Michael Jackson. Michael Jackson's doctor, Conrad Murray is facing charges that claim he breached care standards that ultimately caused Jackson's death. The claim is that he committed medical malpractice by administering anesthetics to the singer in a negligent manner.

The anesthetic that Murray gave Jackson is not a controlled substance, so prosecutors in that case are not going forward with charges under that law. Purportedly, there are concerns that the doctor will attempt to protect himself by saying that Michael was addicted to them and may have given himself the fatal dose. Regardless, Jackson was under Murray's care, even though Jackson was in his own home at the time of the incident.

It could be implied that the doctor was responsible for the administration and adherence to a certain dosage given that he allegedly maintained a watchful eye over the singer.

This does not, however, allow physicians to commit medical malpractice and get away with it by not being held accountable. It is punishable under the law with potentially severe repercussions. Anyone who may be a victim of medical malpractice is encouraged to seek out legal counsel in regard to their rights in these types of cases.
