Can You Bring a Medical Malpractice Case for Laparoscopic Gyn Surgery

Laparoscopic surgery is considered safe, since it is minimally invasive procedure compared to normal surgery. Doctors use fiber optic tools and perform the surgery through very small incision/s, whereas in ordinary surgery the incisions will be huge. However, there are still many risks involved in laparoscopic gyn surgery and you can initiate a medical malpractice lawsuit, if you feel the surgeon did not provide the expected level of medical care.

Risks in Laparoscopic GYN Surgery

There are certain risks in laparoscopic surgery that you should be aware. There are risks associated with inserting the instruments in the belly, and there are risks of injuries that can occur during the course of the surgery.

Risk of Injuries While Inserting Instruments

One particular common risk is to do with the Hassan needle. This needle is thrust into the belly by the doctor to inflate the stomach area, so that the area to be operated on can be easily seen or visualized, which is important in laparoscopic surgery. However, the insertion of the needle into the belly is a blind procedure. The doctors cannot precisely tell where the internal organs are, and therefore the procedure has to be done very carefully and gently. Sometimes the needle can pierce an artery, and if that happens, you can suffer from significant internal bleeding.

The needle could hit the aorta, which is the largest blood vessel in the body, or it could hit the bowel. If the doctor does not realize that you have been injured, during the insertion of the needle, you can suffer from serious consequences. In most cases, doctors will detect the injury when they insert other instruments through other small incisions called ports. Doctors will need to insert a camera device for seeing inside, and other tools to perform the surgery. Hence, when they insert these instruments they might detect the bleeding or injuries caused by the Hassan needle.

Risk of Injuries During Surgery

Injuries can happen intra operatively, which means during the course of the surgery. If considerable time has elapsed from the time the injury happened and the time it was detected, the patient can suffer serious health issues. For instance, the doctors could have finished the surgery and stitched the patient up, and the symptoms of the injuries could surface in the recovery room, when the patient has returned home, or even after a few days. All this can lead to serious health problems, depending when the injury is discovered.

Laparoscopic Surgery is not Risk-Free

You should therefore be aware of the various types of risks associated with laparoscopic surgery, which is usually considered safe because of its minimally invasive nature. The doctor or surgeon should take special care in these procedures, as these risks are common. If the Hassan needle is not inserted with due care or the bleeding injury is not detected in time, it could be grounds for a medical malpractice case. Patients suffering from health issues due to injuries caused during intra operatively could also file lawsuit to claim any deserving compensation.
