Obtaining Medical Malpractice Compensation for a Defective Pelvic Mesh

Many women suffer from pelvic organ prolapse or a dropping of some organs in the pelvic region such as the bladder, urethra, and small bowel because of weakened pelvic muscles after child birth or surgery. This can lead to stress related urinary incontinence and pain. Many gynecologists have been treating this condition using a pelvic mesh.

Multiple Manufacturers

Many manufacturers have been making these pelvic meshes for treating pelvic organ prolapsed. The prolapsed is treated by surgically inserting the mesh into the floor of the pelvis to hold up the organs that are dropping.

Possible Complications

Patients and doctors have found that a pelvic mesh implant can cause many different possible complications. These include a second pelvic organ prolapsed, urinary incontinence, organ damage, scarring, the erosion of the mesh, the mesh penetrating into some other organ such as the bladder or bowel, pain during intercourse, and more. The most serious of these complications is the infection that can lead to death.

Medical Malpractice vs A Defective Medical Product

When a surgical or medical treatment leads to more complications instead of a cure there are two possible causes. One, there was medical malpractice or poor medical treatment that has lead to the complication and two, the medical device used was a defective product that has lead to the health complications.

Defective Medical Device Attorney

A defective medical device attorney will examine the medical records and other aspects of the case to determine if you or a loved one should sue for medical malpractice or a defective medical product. For instance, in the case of a pelvic mesh insertion, if the patient shows adverse reactions soon after the surgery, within a month or so, then it is more likely to be caused by medical malpractice. However, if the patient was recovering well but starts exhibiting negative reactions after six months, this is likely to be caused by a defective pelvic mesh. This is because it takes up to six months for the pelvic mesh to erode and cause scarring or other complications.

Compensation Claim

Once the medical malpractice or defective medical device attorney has determined the actual cause of the adverse medical conditions, they will file a case for compensation against the at fault party. They will present the evidence collected and ask the court to award a compensation that covers the additional medical costs incurred, pain and suffering endured, lifestyle changes, loss of income, and so on.

The lawyer will argue the case in court and try and show that the pelvic mesh was the cause of the poor health of the patient. This is possible as many patients have now come forward with adverse reactions to the pelvic mesh that was implanted in them. This has also opened up the possibility of filing a class action suit against the manufacturer of the pelvic mesh used on you. While the FDA normally approves devices that have a side effect on a small section of the population, in the case of pelvic mesh implantations, the records show that the manufacturers did not reveal all the possible side effects when marketing the products.
