Study looks into injuries related to laser surgery

People who have undergone laser hair removal may be interested to learn that New York is one of the few states where people can perform this procedure without an operating license. New York is also a state that has seen some of the highest numbers of malpractice lawsuits related to laser surgery injuries.

In a study that was published in 2013, a Harvard Medical School doctor and other researchers looked into data on laser surgery malpractice cases. Researchers found that there have been 174 cases of skin injuries related to laser surgeries over the period between 1985 and 2012. The highest number of these injuries occurred after laser hair removal followed by skin rejuvenation and laser treatment of leg veins. Many of the injuries that were reported were burns, while other injuries involved scars and changes to the plaintiff's skin color.

The researchers found that although physicians did not always perform the laser procedures where injuries occurred, a physician was usually named as the defendant in the lawsuits under the theory of vicarious liability. Physicians were accused of failing to train and supervise staff as well as failing to inform patients about the potential hazards of procedures and failure to use the appropriate devices.
