What does a Lawyer Look for in a Potential Medical Malpractice Case

If you feel that you have suffered harms and losses due to the negligence of a doctor or a hospital staff, you should consider claiming damages by filing a medical malpractice lawsuit. However, when you approach an attorney, he will be looking at your case from his own viewpoint to decide whether he should accept it. Hence, these are the four important aspects a lawyer will be looking at, when a client approaches him with a potential medical malpractice case.

The lawyer will first look for honesty in his client. Your attorney will consider how honest you are in describing what happened to you. To your lawyer, honesty will be the keystone or foundation for your case, because your credibility is going to be the be-all and end-all of your case.

If you are not credible in telling your story, in explaining what happened to you, then your case is over before it ever begins. It is crucial for you to explain to your attorney what occurred in a straightforward and honest fashion. If for some reason you are not honest with your attorney and seem to be hiding pivotal information and certain details, then this will create significant problems for you and your attorney down the road.

Your Looks and Attire

If you go to an attorney wearing sandals and torn t-shirt, you might not get his attention. However, this does not mean you have to dress immaculately and present yourself as you would at a job interview. An attorney mainly will mainly look at you as if you are a witness taking the stand at a trial two or three years down the road. Your attorney will look to see if you will be presentable to a jury. The way you present yourself is extremely important from an attorney's viewpoint.

Are You Seeking Vengeance or Justice

An attorney will consider whether you are out to get vengeance or whether you are seeking justice for what has happened to you. Even though both approaches seek the same result, there is a subtle distinction. The manner, in which a client seeking justice will behave, will be quite different from a client seeking vengeance, and an attorney will prefer a client seeking justice and showing dignity in their pursuit.

The attorney will be looking at how the jury is going to perceive you at trial. If you are hostile, angry, with malice your thoughts and countenance, the jury will recognize that and know that you are not here for true justice.

Do You Want to Improve Your Life or Line Your Pockets

An attorney will consider whether you are pursuing the case simply to get compensation or you are trying to regain your health and recover from your injuries. This is important because ultimately at the trial, the jury is going to look at you and decide whether they should award you money or not. The jury should feel that you are trying to make the best out of your life and your disabilities by trying to improve your life rather than having avarice in your heart and hoping become rich because of your unlucky situation.
