What to do after surgical errors

By Rosenberg, Minc, Falkoff & Wolff, LLP. posted in Surgical Errors on Wednesday, June 20, 2018.

New York residents who undergo surgical procedures might be victims of surgical errors. When this occurs, it is important that the patients understand why the error occurred, how the surgeon can correct the errors and injuries and what legal steps should be taken.

New York residents who undergo surgical procedures might be victims of surgical errors. When this occurs, it is important that the patients understand why the error occurred, how the surgeon can correct the errors and injuries and what legal steps should be taken.

Before undergoing surgery, patients can take proactive steps to protect themselves. They should conduct research on their diagnosis and study their treatment options. They can seek out a surgeon who specializes in their particular medical conditions. Getting second opinions about their condition is also advisable. Patients should be aware of what will happen during their surgery and what types of complications can occur.

Before the surgery takes place, patients should insist on having hospital follow-up appointments with the surgeon and not a physician assistant. Relatives and friends can be asked to remain in the hospital for the duration of the surgery. Once the surgery has been completed, patients should not hesitate to speak up about intense and sharp pain.

When patients have been notified that there was an error during their surgery, they should speak with their surgeon about the incident as well as with a patient advocate. It is important that they obtain a copy of all of their hospital records.

An investigation into the surgical error should be requested, and the patient should submit a grievance or complaint to the hospital and to the state medical board. When selecting an attorney to protect their interests and rights, patients can make sure that the attorney's expertise is in malpractice and negligence law.

A medical malpractice attorney may litigate to obtain financial compensation for a client who was a victim of faulty surgical performance. Lawsuits may be filed against surgeons and hospitals for pre-operative care errors, wrong site surgery or the improper use of medical equipment.
